Rental Terms

I acknowledge, agree and/or warrant to the following Contract Terms:

1. I have received and understand the Deposit Terms and Cancellation Policy.

2. I agree to follow the posted rules with regard to use of the Camper.

3. I agree to obey all applicable laws.

4. I agree that I will not move the Camper from the designated Location.

5. I agree to allow no animals, not previously authorized by R & D, to enter the Camper.

6. I agree that only the Permitted Campers will be allowed to stay in the Camper.

7. I agree to immediately report to R & D any damage to the Rented Equipment and/or any malfunctions, inclusive of loss of

water, electrical service and propane.

8. I agree to make no attempts to repair the Rented Equipment without R & D’s prior consent.

9. I agree to immediately pay the stipulated rental fee and execute the Credit Card Authorization, which is incorporated herein

by this reference. If any Rented Equipment is damaged or destroyed by me, regardless of the circumstances under which damages occur, I agree that I am personally responsible and authorize R & D to immediately charge my credit card for the amount of the damages and labor as a reimbursement. I agree that all damaged parts will be replaced with new parts. I agree to immediately pay for lost rental income for the period the Camper is out of service due to damage for which I am responsible. I agree that default interest shall accrue at the rate of 18% per annum on all amounts not timely paid. Additionally, I agree to immediately pay all attorney’s fees, court costs and expenses of collection incurred because of my breach hereof. I agree that the exclusive jurisdiction and venue for any legal action to enforce this Contract and Release shall be in Grand County, CO, regardless of my residence, (Colorado law shall apply to this Contract). To the extent that any part of this Contract and Release is found to be invalid, void or illegal under applicable law, that part shall be inapplicable, and the remainder shall continue in full force and effect.

10. I agree that the Rented Equipment will be operated only for the use it was intended; and agree that this document shall bind me. I acknowledge that I will have the opportunity to inspect the Rented Equipment to verify that it is received by me in good and operational condition. After such inspection, I will be asked to complete and sign the Equipment Checklist, the executed copy of which will be incorporated herein by this reference. The Rented Equipment will be returned by me in the original rented condition. I understand R & D reserves the right to refuse service to any person for any reason which is not prohibited by law including, but not limited to, the Permitted Campers’ failure or refusal to comply with any instructions, requirements, rules, regulations, directions, imposed by R & D and/or any applicable governmental agencies.

I acknowledge and agree to the following Release terms:

1. “The Released Parties”: R & D, its’ members, managers, employees, agents, affiliates, successors, assigns, and the owner of the Location.

2. By signing below, for myself and all other individuals I allow into the Camper, I hereby acknowledge that I have been informed, and I understand, that participating in this activity involves risks. Certain risks are inherent in using a Camper and cannot be eliminated. These risks can be the cause of loss or damage to my property, accidental injury, illness, or in extreme cases permanent trauma or death. Among these risks are the following: (1) the acts or omissions of others; (2) latent or apparent defects or conditions in equipment; (3) weather conditions; (4) interaction with animals; (5) health issues associated with high altitude; (6) exposure to exhaust; and/or (7) lack of first aid, emergency treatment or other services rendered. I understand and acknowledge that the above list is not complete or exhaustive, and that other risks, known or unknown, identified or unidentified may occur. I also acknowledge that I fully understand the nature and physical demands of camping and the inherent dangers associated therewith.

3. Being aware that this activity entails risk, I agree, covenant, promise and assume all responsibility or liability and risk for injury, death, illness, disease, or damage to property, real or personal, arising out of or in any way connected with my participation in this activity, use of the Camper or other personal property provided by R & D, and/or all negligent acts or omissions of others, (collectively the “Potential Causes”). If I have any preexisting physical ailments, I am aware that camping may cause ailments to re-occur or increase in intensity. I will not hold the Released Parties liable for ailments or injuries.

4. I acknowledge that the Released Parties make no representations or warranties of any kind regarding the experience of camping, weather conditions, and/or the Location.

5. Participation in this camping is purely voluntary, no one is forcing me to participate, and I elect to participate in spite of, and with full knowledge of, the risks. I hereby certify that I and all the Permitted Campers are fully capable of participating in this activity.

6. To the fullest extent permitted by the applicable laws, I hereby voluntarily RELEASE AND FOREVER DISCHARGE the Released Parties from any and all liability, claims, inclusive of reasonable attorney's fees and costs incurred, demands, actions or rights of action, loss, damages, injury to persons or property, which are related to, arising out of, or in any way connected with the Potential Causes.

7. I agree, promise and covenant to WAIVE any and all rights, claims, causes of action or rights to a certain claim which I may have or acquire against the Released Parties with regard to the Potential Causes. I agree, promise and covenant NOT TO SUE, assert or otherwise maintain or assert any claim against the Released Parties for any injury, death, illness or disease, or damage to my property, arising out of or in any way connected with the Potential Causes. I further agree, promise and covenant to HOLD HARMLESS AND INDEMNIFY the Released Parties from any and all liability, claims, inclusive of reasonable attorney's fees and costs incurred, demands, actions or rights of action, loss, and/or damages, which are related to, arising out of, or in any way connected with my breach of this Contract and Release.

8. I understand and acknowledge that by signing this document I have given up certain legal rights or possible claims which I might otherwise be entitled to assert or maintain against the Released Parties.

9. This Contract and Release shall apply, inure, and be binding upon me and/or other Permitted Campers, and our respective heirs, personal representatives, invitees, administrators, successors and/or assigns.

10. I understand this Contract and Release is a binding contract that supersedes any other agreements or representations and that this Release is intended to provide a comprehensive release of liability to the greatest extent permitted by law. If any part of this Contract and Release is deemed unenforceable by a Court of proper jurisdiction all other parts shall be given full force and effect.

11. I understand that this agreement cannot be modified or changed in any way, except in a writing signed by the parties. This Contract shall be governed by and construed under the laws of the State of Colorado. This Contract and Release contains the entire agreement of the parties, and no representations or promises not contained herein shall be binding or enforceable.

I HAVE CAREFULLY READ AND FULLY UNDERSTAND THIS CONTRACT AND RELEASE. I AM COMPETENT AND DULY AUTHORIZED TO SIGN THIS DOCUMENT FOR MYSELF AND ALL OTHER INDIVIDUALS I ALLOW INTO THE CAMPER. I AM AWARE THAT BY SIGNING THIS DOCUMENT I AM WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. I SIGN THIS CONTRACT AND RELEASE OF MY OWN FREE WILL AND INFORMED INTENT.

AUTHORITY TO BIND MINORS:

If any of the Permitted Campers are minors or otherwise unable to enter into a contract, I, the undersigned, represent and warrant to R & D that I am the parent or legal guardian of the above-named person(s) and that I am authorized to sign this document on their behalf. I consent to such person's participation in these activities with knowledge of and in spite of the risks. I affirm that I have read and understand this document and I agree that the person(s) shall be bound by all of the terms of this Contract and Release, both now and after they reach age of majority or end of any incapacitating condition. I hold harmless and indemnify the Released Parties for any claims, damages, actions, causes of actions, including reasonable attorney's fees and costs, incurred as a result of my misrepresentation or breach of warranty under this provision.
